General Terms and Rental Conditions (GT&Cs)

1. Scope

1.1 These terms apply to the rental of motorised two-wheelers from SCO2T. “You” means the renter, whether a consumer or a business.

1.2 The booking confirmation and the price list valid at the time of booking (as of October 2026) form part of the contract.

1.3 Changes to these terms apply only to bookings made after their publication.

2. Who may ride

2.1 Only persons may ride who

  1. are at least 18 years old,
  2. have held a driving licence valid in Austria for the booked vehicle for at least 12 months,
  3. present an official photo ID and their driving licence, either the original or a digital form legally recognised in Austria, at handover, and
  4. have been registered by us as a rider at handover.

2.2 If your driving licence was issued outside the EU, the EEA or Switzerland, you also need an International Driving Permit or a certified translation where Austrian law requires one.

2.3 Carry your driving licence with you while riding. If your licence is revoked, a driving ban applies or your licence is lost, you may not ride for that period.

2.4 You may not hand the vehicle over to anyone we have not registered as a rider.

2.5 Businesses only: You name at least one rider. If you use several riders, you record each rider and the period of use, make sure each of them meets the requirements of Article 2.1 and present these records on request. You are liable for breaches by your riders.

3. Booking and conclusion of contract

3.1 Your online booking is an offer. The rental contract is concluded as soon as we confirm the booking by e-mail.

3.2 The rental period is stated in the booking confirmation. It starts at the booked time, even if you collect the vehicle later. The minimum rental period is 7 days; other periods by agreement.

3.3 If the booked vehicle is not available, we offer an equivalent or higher-category vehicle at no extra charge.

3.4 If you do not meet the requirements of Article 2 at handover, we will not hand over the vehicle. Article 4.2 then applies.

3.5 How we process your data – including location data under Article 6.8 and the payment data stored with our payment service provider – is explained in our privacy policy.

3.6 For long-term rentals without a fixed end date and for bookings by businesses, we may check your creditworthiness with CRIF GmbH, Rothschildplatz 3/Top 3.06.B, 1020 Vienna, Austria, before confirming the booking. We do not do this routinely for every booking. A person decides on the booking; if we decline it, we refund all payments in full. 4. Cancellation and no-show

4.1 You can cancel by e-mail to office@sco2t.com; the time of receipt is decisive. We refund the rental price paid less the following cancellation fee:

4.2 If you do not collect the vehicle within 2 hours of the start of the rental and have not cancelled, we retain the no-show fee and refund the remainder.

4.3 For vehicle rentals booked online for a specific date, there is no statutory right of withdrawal (§ 18(1)(10) Austrian Distance and Off-Premises Contracts Act, FAGG). We grant the cancellation rules in this Article voluntarily.

4.4 Up to 24 hours before the rental starts, you can rebook once free of charge to another date within 6 months, subject to vehicle availability. We settle any price difference.

4.5 If we have to cancel a booking, we refund all payments in full. We initiate refunds to the original payment method within 3 working days.

5. Prices, payment, deposit

5.1 The price list valid at the time of booking applies. All prices include VAT. Additional charges (cleaning, refuelling/recharging, vehicle recovery, extra kilometres, helmet replacement, handling fees) are listed there exhaustively.

5.2 For online payment, you pay the full rental price, including any booked extras, when booking via our payment service provider. We accept credit and debit cards, Apple Pay and Google Pay; we do not accept prepaid cards. Alternatively, you can pay in cash at handover, except where the vehicle is delivered. For cash payment, we invoice any cancellation fees under Article 4.

5.3 For online payment, we do not require a deposit. Instead, our payment service provider stores your payment method until 30 days after the end of the rental. By booking, you authorise us to subsequently charge amounts arising from this rental contract to this payment method in accordance with Article 5.4. After that, we delete the stored payment method. For cash payment, you pay a cash deposit of €500 at handover. We refund it on return unless there is damage or outstanding claims; we may set off outstanding claims arising from the rental contract against the deposit and provide an itemised statement.

5.4 Before any subsequent charge (e.g. for refuelling/recharging, late return, damage or traffic fines), you receive an itemised statement with supporting evidence by e-mail. We charge no earlier than 5 days afterwards so that you can raise objections; we do not charge amounts that are the subject of justified objections. Amounts exceeding the agreed excess and charges that fail are invoiced; they are due 10 days after receipt.

5.5 In the event of late payment, we charge statutory default interest as well as reminder and debt collection costs. We may assign claims to debt collection agencies.

6. Handover, use and return

6.1 The vehicle is handed over in person at the address stated in the booking confirmation at the booked time. Together with you, we record the vehicle’s condition in a handover report with photos. Check the vehicle before setting off and report any visible defects before departure.

6.2 You receive the vehicle clean and with a full tank or fully charged. You return it clean and with a full tank. Electric vehicles do not need to be recharged before return. We charge any refuelling and cleaning costs (in the case of heavy soiling) according to the price list.

6.3 Unless otherwise agreed, you may only use the vehicle in Austria. The included kilometres are stated in the booking confirmation; extra kilometres are charged according to the price list.

6.4 Return the vehicle at the agreed time to the handover address, together with the key, helmet(s), vehicle documents and first-aid kit. The rental ends with the joint return report.

6.5 For a fee, we deliver the vehicle to, or collect it from, an agreed location in Vienna; outside Vienna on request.

6.6 If you return the vehicle more than 1 hour late, we charge €30 per started calendar day.

6.7 The rental can only be extended with our confirmation.

6.8 If you leave the vehicle at a location other than the one agreed, we charge the recovery according to the price list as well as any towing and parking costs incurred.

6.9 Our vehicles are fitted with GPS tracking devices. During the rental period, we only retrieve the vehicle’s location if

  • theft or misappropriation is suspected,
  • the return is more than 1 hour overdue and we cannot reach you,
  • you or emergency services need assistance after an accident or breakdown, or
  • the device automatically reports that the vehicle has left the permitted area of use (Article 6.3).

We do not analyse a movement profile of your journeys. We delete location data 90 days after the end of the rental unless it is needed to clarify a specific incident. Details and your rights are explained in our privacy policy.

7. Helmet and equipment

7.1 Your rental includes one helmet free of charge; a second helmet for a passenger can be booked as an extra. Helmets are mandatory for both rider and passenger. You may use your own helmet if it complies with the ECE standard.

7.2 We charge for replacing lost or damaged helmets and accessories according to the price list.

7.3 You use phone holders and USB ports at your own risk.

8. Accident, damage, theft, breakdown

8.1 Report accidents, damage, theft and loss immediately to office@sco2t.com.

8.2 Notify the police of every accident and of any damage caused by unknown third parties. This is not necessary if, in the case of property damage only, details have been exchanged in accordance with § 4(5) of the Austrian Road Traffic Regulations (StVO), or if only a minor scratch has occurred without third-party involvement. If the police refuse to record the incident, note the police station, date and time.

8.3 If a warning light comes on (other than the fuel or battery indicator), stop in a safe place and contact us. In the event of a breakdown, we arrange assistance. We bear the costs unless you caused the breakdown.

8.4 Do not admit liability or acknowledge any claims towards third parties, and do not make any payments. Send us an accident report within 5 days.

8.5 If the vehicle is no longer roadworthy after an accident, the rental ends when it is handed over to us or to the towing company we have instructed. You only bear the recovery costs if you caused the accident.

8.6 We choose the repair shop. Compensation paid by third parties for damage to our vehicle is due to us; if you receive any such payments, you must pass them on to us.

9. Rules of use and traffic fines

9.1 Treat the vehicle with care, comply with the Austrian Road Traffic Regulations (StVO) and Motor Vehicles Act (KFG), secure the vehicle when parking (steering lock engaged, seat locked) and keep your contact details up to date.

9.2 The following is prohibited:

  • riding under the influence of alcohol (0.0 per mille), drugs or medication that impairs your ability to ride,
  • racing, off-road riding, riding lessons and vehicle tests,
  • commercial carriage of passengers or goods (e.g. for delivery services) without our written consent, and subletting,
  • carrying hazardous substances or loads that impair riding safety,
  • carrying children under 12 years of age or passengers who cannot reach the footrests,
  • trips abroad,
  • unauthorised repairs or modifications,
  • use for committing criminal offences.

9.3 You bear traffic fines, fees and towing costs incurred during the rental period. If an authority asks who was riding the vehicle (§ 103(2) KFG), we disclose your details. We charge a handling fee of €20 per case.

9.4 Anyone using a vehicle without a valid rental contract or after the end of the rental pays a contractual penalty of €250. We reserve the right to claim further damages separately.

10. Your liability and liability reduction

10.1 All vehicles have third-party liability insurance. This insurance covers damage to third parties, not damage to the rental vehicle.

10.2 You are liable in accordance with the statutory provisions for damage to the vehicle, theft and loss during the rental period.

10.3 Your liability per incident is limited to:

10.4 The liability reduction does not apply if you caused the damage intentionally or through gross negligence, in particular in the event of a breach of Article 9.2.

10.5 We only charge for loss of use in cases of intent or gross negligence.

10.6 We document all damage with photos from the handover and return reports.

11. Our liability

11.1 We are liable for damage caused intentionally or through gross negligence in accordance with the statutory provisions. In cases of slight negligence, we are liable for personal injury and for breaches of essential contractual obligations. For property damage and financial loss caused by slight negligence in breach of essential contractual obligations, our liability is limited to the damage typical for this type of contract and foreseeable.

11.2 If you cannot use a vehicle because of a technical defect not caused by you, we provide a reasonable replacement vehicle. If this is not possible, we refund the rental charge pro rata for the proven period during which the vehicle could not be used.

11.3 Mandatory liability under product liability law remains unaffected.

11.4 We keep items left behind for 4 weeks.

12. Early termination and long-term rental

12.1 Either party may terminate the contract with immediate effect for good cause. For us, this applies in particular in the event of late payment despite a reminder, false information about identity or driving licence, or a serious breach of Article 9.2.

12.2 After the rental has ended, return the vehicle without delay. The rental price is payable until the vehicle is returned; if you are at fault, we charge the proven damage.

12.3 Rentals of 30 days or more without a fixed end date may be terminated by either party with one month’s notice to the end of a calendar month.

13. Final provisions

13.1 Austrian law applies. Consumers retain the protection of the mandatory provisions of the country in which they have their habitual residence.

13.2 Businesses: The place of jurisdiction is the court with subject-matter jurisdiction in Vienna. Consumers: The statutory places of jurisdiction apply.

13.3 Businesses: Amendments and additions must be made in writing; e-mail is sufficient.

13.4 The German version is authoritative. The English version is provided for information only.

13.5 If any provision is invalid, the remaining provisions remain valid. In relation to businesses only, the invalid provision is replaced by the valid provision that comes closest to its purpose.
